Are You Ready for SAPA?
The legislative intent behind the Serious Accident Punishment Act ("SAPA") is to prevent serious accidents by imposing strict punishment on the companies and the top decision makers, including the CEO.
The SAPA will become effective on January 27, 2022 for companies with 50+ employees. The Enforcement Decree of the SAPA was finalized in October 2021 and provides some more details on the companies' broad obligations to secure safety and health.
It not only covers typical serious industrial accidents (e.g., factory/warehouse/construction accidents), but also serious public accidents that receive wide societal attention (e.g., the humidifier disinfectant scandal and the Sewol ferry tragedy).
